Order BEFORE: WEICK, LIVELY and KEITH, Circuit Judges. In this diversity action the plaintiff appeals from an order denying her motion for a new trial following a jury verdict in favor of the defendant in a wrongful death action. The plaintiff argues that there was no substantial evidence from which the jury could have concluded that the defendant was free of liability. Upon examination of the record on appeal the court notes a conflict in evidence concerning factors which had a direct bearing on the question of proximate cause of the collision in which plaintiff's decedent was killed. It is also noted that the plaintiff made no request to exclude or limit the jury's consideration of any of the evidence which bore on the issue of proximate cause. The evidence in the case presented issues for the jury which were decided adversely to the claims of the plaintiff. There was no abuse of discretion in the denial by the district court of plaintiff's motion for a new trial.
